POLICY ON PRODUCTS PROHIBITED FOR SALE

List of products prohibited for sale by Seller Online LLC

Before using the services of Seller Online LLC (“Seller Online”) as your authorized reseller and sender of handmade gifts on the Internet (in accordance with the provisions of the User Agreement, which is incorporated by reference into and made a part of this Policy) by offering products in the Seller Online system, in particular on the Website WWW.SELLER-ONLINE.COM and/or at any partner domain addresses or on any partner websites, please make sure that Seller Online allows the sale of these products. The following is a non-exhaustive list of prohibited products.

We also ask that you familiarize yourself with our terms and conditions before selling your products to Seller Online or on its system. You are solely responsible for ensuring that the sale of your products is in compliance with all applicable regulations and all Seller Online requirements.

I. BASIC REGULATIONS

  1. Our policies are based on the federal and state laws of the United States of America. Before using our Services, please also ensure that you sell your products in accordance with the laws of your country, state, province, etc. Sellers are responsible for ensuring that their transactions are legal in both the seller’s country and the buyer’s country. We strongly recommend that all Sellers to thoroughly familiarize themselves with the laws of their own country, as well as the countries in which they intend to conduct business.
  2. Compliance with the federal and state laws of the United States of America is mandatory. This also means that Sellers are responsible for declaring and paying all applicable sales taxes. In addition, Sellers are responsible for the payment of all import and export duties and for compliance with any other customs regulations.
  3. Sellers are prohibited from selling products that violate the intellectual property laws of the United States or any other country. The mission of Seller Online is to provide a safe place to buy and sell products and to protect intellectual property rights. The unlawful use of intellectual property, such as copyrighted materials, patented products, and trademarks, is considered a violation of the law and the provisions of the Seller Online User Agreement.
  4. Sellers are obliged to accompany their products with only accurate and reliable descriptions in compliance with legal requirements. As a Seller, you are ultimately responsible for the legality of each product you sell through Seller Online, as well as for the legality of its description.
  5. Sellers may sell only tangible goods on Seller Online. A “tangible good” is a tangible good that is sent to the physical address of the Buyer or an online user.
  6. When using the Seller Online Services, Sellers shall comply with the provisions of the User Agreement.
  7. The following non-exhaustive list of prohibited items contains items that Sellers may not sell while using the SellerOnline Services.

II. LIST OF PRODUCTS PROHIBITED FOR SALE

The following products and services are prohibited for sale through Seller Online:

  • ANY products manufactured in Cuba, North Korea (Democratic People’s Republic of Korea, or DPRK), Iraq, Iran, Afghanistan, Burma (Myanmar), Somalia, Zimbabwe, Yemen, Sudan, Libya, Lebanon, Syria, Crimea (Autonomous Republic of Crimea, ARC), DPR and LPR, Russia, and Belarus.
  • ANY MEDICAL DEVICES and products for health and beauty, as well as MEDICAL PRODUCTS for humans and animals, including pills, intravenous injections, external preparations, ointments, creams, soaps (liquid and solid), lotions, bath products and herbal medicine.
  • ANY FOOD PRODUCTS for humans and animals, including food additives, alcoholic and other beverages, dietary and vegetable additives.
  • Checks and other rewards from affiliate programs, gift cards, certificates, bank checks, money orders, traveler’s checks, bank cards (including expired ones), and any payment instruments.
  • ANY ADVERTISING OR OTHER SERVICES, including anything that is not a product: club memberships, online training, information about working from home, employment services, rental services, SEO and SMM services, employment contracts, consulting services, design services, sale of advertising space, and freelance services.
  • ANY merchandise bearing the name or logo of a company other than the manufacturer, including car stickers with automakers’ logos, T-shirts with logos, drawings, artwork, and handmade items with logos and/or brand names.
  • ANY NEW OR ALREADY ACTIVATED SIM CARDS, as well as any communication devices, communication services and communication service agreements.
  • ANY SOFTWARE, INCLUDING BUILT-IN SOFTWARE, including those designed to block and/or hack and/or overclock the power of mobile phones or computer processors.
  • ANY GOODS FROM CRIMEA that are made in Crimea or sent from Crimea, that have any relation to Crimea or contain the words “Крым” or “Crimea” in the description.
  • ANY PRODUCTS bearing the insignia of the GRU or the FSB, either on the products themselves or in their descriptions, as well as copies of such products, including uniforms, documents, awards, badges and tokens, printed matter, including products produced by or intended for use by these organizations, and any products or product descriptions bearing the names or mentioning the names of companies under US or EU sanctions, such as Yandex. Money, VTB24, Sberbank, and other companies on the sanctions lists of the U.S. Financial Crimes Enforcement Network (FinCEN) and the Office of Foreign Assets Control (OFAC).
  • Articles made from the skin of wild or domesticated animals, except leather jackets, haberdashery and other articles made from the skin of cattle, sheep, pigs, rabbits or hares.
  • Wild and domestic animals, including live animals, as well as carcasses, stuffed animals, body parts, skin, bones, horns, tusks and fangs.
  • Live, preserved or dried insects (except for insects in amber, resin and other hardened substances in jewelry).

  • ANY NEW BRANDED GOODS or branded clothing of well-known brands (such as ADIDAS, PUMA, MICHAEL KORS, etc.).
  • Any used branded goods or clothing, accessories, and haberdashery, including shoes and bags, worth more than $400, which are offered for sale without certificates of authenticity.
  • Human body parts, including specimens, exhibits, mannequins and other imitative representations of human body parts, human organs and tissues, blood and its components, human and animal embryos, human remains, including exhumed and cremated human remains, as well as human hair (including products made from natural human hair, wigs, brushes, and lining) and teeth.
  • ADDITIONAL INTERACTIVE SOFTWARE FUNCTION in the form of files or access to them, including scripts, product search programs, security programs, and other programs.
  • ANY GPS SATELLITE NAVIGATION EQUIPMENT, new or used, with or without software, that is used to locate machinery and equipment (e.g., tractors, pipe-layers, drilling rigs) and is installed by the manufacturer of such machinery and equipment, except for GPS for motor vehicles.
  • ANY DIGITAL MEDIA, including new and used CDs, HDDs, USBs, and DVDs, regardless of their content (except for collectible records and magnetic tape cassettes).
  • Banknotes, coins, stocks, bonds, and promissory notes (it is allowed to sell coins, bonds, and banknotes that are outdated and have only collector’s value).
  • Catalytic converters and tubes.
  • Charitable contributions, donations, and fundraising (so-called fundraising and crowdfunding), including on GoFundMe, Kickstarter, and Indigo (except for campaigns pre-approved by Seller Online).
  • New and used cell phones with connection agreements.
  • Real and counterfeit currency and counterfeit stamps.
  • Narcotic and psychotropic drugs, in particular in the form of medicines, aerosols, smoke and vapor, and especially tobacco, tobacco products, smoking aids, hookahs, bongs, e-cigarettes and their components, as well as fillers and mixtures for hookahs and e-cigarettes.
  • Prescription drugs and certain products whose circulation is regulated by the state.
  • Recalled and unapproved medicines, as well as dietary supplements prohibited by the state.
  • Electronic equipment prohibited by the Federal Communications Commission (FCC).
  • Embargoed goods.
  • Sale of goods whose supply is prohibited in the buyer’s country.
  • Explosives, fireworks and pyrotechnics, as well as their components.
  • Weapons, firearms and any of their components, including stocks, sights and bayonets, but excluding belts, covers, safety belts, ammunition belts, holsters and other means for carrying and storing weapons (without the actual weapon and ammunition).
  • Items whose imports and exports are regulated by the importing or exporting country, including items regulated by the U.S. Defense Trade Administration under the International Traffic in Arms Regulations (ITAR), Title 22, Code of Federal Regulations, Parts 120-130, and/or the Export Administration Regulations (EAR) of the U.S. Department of Commerce: night vision devices, optical sighting systems, thermal imagers/infrared equipment.
  • Cosmetic products for skin and hair, including creams, oils/butter, paints, shampoos, eye shadows, lipstick, cosmetic pencils and bath products.
  • Games for computers and game consoles.
  • Items and accessories for gambling.
  • Genuine or fake government documents, identity cards, and licenses, including passports, employment records, and other important documents, except for photocopies of documents and certificates issued by notaries.
  • Products related to the work of the U.S. government and armed forces, including aircraft operating manuals, subway uniforms, products related to the U.S. Postal Service, police badges and uniforms, and mailing bags.
  • Hazardous materials, flammable and corrosive substances.
  • Hotel and airline reservations, travel agency services.
  • Perks, benefits, coupons, and discounts.
  • Multi-level marketing, pyramid schemes, and similar products.
  • Strategic, diplomatic and classified materials.
  • Personal data, credit card information, and phone numbers.
  • Pornographic products or access to products of a pornographic nature or content.
  • US satellite or cable television equipment and related hardware.
  • Software and software keys sent by e-mail (and any information or software sent on the Internet, by e-mail, through a website, or by fax).
  • Documents and certificates of ownership of real estate and other securities.
  • Stolen property or property with a questionable or missing registration number.
  • Sale of any tickets, including lottery tickets, travel tickets, tickets for various events, flights, tours, and travel.
  • Cryptocurrencies, including bitcoin and all others.
  • Hosting, site access, design and development, memberships, membership upgrades or rewards, advertising, and other bonuses, points, or any electronic currency or electronic rewards, including coupons.
  • Precious metals (silver, gold, platinum) in the form of ore or in ingots, powder or scrap metal.
  • Coins and jewelry made of precious metals are allowed for sale only after prior approval by Seller Online.
  • All types of knives, including automatic knives, fixed-blade knives, folding knives, spring-loaded knives, and pocket knives with blades longer than 9 cm.
  • Products that resemble civilian and service weapons, markers, paintball/strikeball weapons and components, stun guns, gas pistols and air guns, as well as self-defense equipment such as pepper spray and pepper spray cans, brass knuckles, batons, ceramic knives, axes, etc.
  • Radioactive and toxic materials, as well as any reagents and chemical compounds with poison.
  • Flammable substances and liquids, including zinc powder, acetone, any type of lighter fuel, solvents, perfumes, colognes, toilet water (except nail polish), enamel/varnish paints and glue.
  • Explosive products (including those under pressure, such as fire extinguishers, airbags, oxygen tanks, water immersion tanks, etc.).
  • Ozone-depleting and polluting substances (any aerosols, sprays, disinfectants, self-crushing substances, dry ice, herbicides, insecticides, pesticides, household and medical waste, other hazardous waste).
  • Pathogenic and infectious substances, live viruses and bacteria.
  • Items prohibited by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), including stuffed animals, skin, bones, tusks and fangs of rare animals.
  • Hazardous new and used batteries, such as lead-acid batteries, alkaline batteries, including car batteries, lithium batteries without devices, or damaged or used batteries of any type: alkaline, nickel-metal hydride (NiMH) or nickel-cadmium (NiCd) batteries (except for batteries for mobile phones, digital cameras and laptops).
  • Works of art and works of cultural value that require mandatory certification.
  • Materials for adults in the form of printed, sound, visual and other information that can be classified as pornography, except for “adult toys” (condoms, mechanical and electrical intimate devices, dolls, etc.) and artistic works (e.g., nude images).
  • Materials in the form of printed, audio, visual and other information containing Nazi attributes or similar symbols, as well as any products that promote discrimination on any grounds, including anti-Semitism.
  • Goods, the delivery of which is prohibited by the norms of the Universal Postal Union and the customs legislation of the country of departure/destination.
  • Things and objects that, due to their properties, can damage postal premises or pose a danger to postal workers, including infection or contamination or damage to other mail and postal equipment (graphite powder, sand, dry gypsum powder without proper packaging, etc.).
  • Goods with calls to commit extremist and terrorist acts or to public support and propaganda of terrorism.
  • Information and propaganda materials that may in one way or another harm the political or economic interests of the Customs Union member states, in particular their state security, health and moral principles of their citizens.
  • Campaign documents and materials created or distributed in violation of the requirements of the legislation of the Customs Union member states on elections and referendums.
  • Ancient monuments of cultural value and other archaeological sites of high importance.
  • Any products for plant care and protection, any poisons and chemicals.
  • Specialized radio receivers for live technical radio interception, as well as any scanning radio receivers.
  • Specialized devices with which the user can enter and inspect any premises, as well as devices for illegal entry into vehicles, and other products and technologies that help open locked devices, with the exception of ordinary sanitary and carpentry tools.
  • Advertising sales.
  • Recalled goods.
  • Goods protected by patents, trademarks and copyrights, illegal copies of licensed goods and illegal distribution of licensed goods.
  • Any other products that Seller Online LLC considers unacceptable.

III. INCLUSION IN THE USER AGREEMENT

This List of Prohibited Products is included in the text of the Seller Online User Agreement.
